Anyway, I found an attorney and gave him my case a few months ago back on June 24 and it took him until August 25 to get a first response/offer from GM which was crap. Basically they offered me less money than my attorney would get in fees and an extended warranty. My attorney agreed that it was crap, so he rejected the offer. The thing is, from June to Aug, he never spoke with me, I always speak to his assistant and when I asked to speak with the attorney, he only promisses me that he will call me back, and NEVER does. So I called on Aug. 25 and told them that if I don’t get a call back from the attorney to find out what in the hell is going on, then I’m going to find another attroney. He then called me back and told me that he got an offer from GM…..what a coincidence, they day I threaten them going to a different attorney, he calls back and gives me this shitty offer, that even he told me not to accept. Back to The waiting game again. Since Aug 25, he hasn’t gotten back to me. Is there something wrong with my lawyer or is this lemon law process normal. What should I do?

Also, the Attorney General in her state opened a suit against her shortly after. They contacted me and asked me to file a complaint with them and I did. Apparently, there were many consumers with similar complaints. All consumers were unaware that signing this contact, they were waiving their rights of a lemon law that most people don’t know exists. Since my case has been over, and I didn’t receive any pmt, I ordered a capias. That didn’t do any good because the sheriff will not go out of the state to do an arrest. Meanwhile, the capias expired 11/07. However, the Attorney G shut her business down in her state and is still seeking restitution for the consumers. My problem is, she is not selling her pups in her state anymore, but she is in another state doing it, and still has her website up and running. I’m not sure if there is anything else I can do. I can’t stand the thought of this woman getting away with what she’s doing. Any suggestions? Sorry for the book.

I sold a 1995 Saturn SC1 last week to this guy. We negotiated a price of $775 because it needed a new radiator and a tune-up. I made sure he knew that my husband drove this car to his job everyday without problems. That the radiator needed to be changed before driving it a long way. He said ok and we made the transaction. I wrote on the biil of sale “Car is sold AS-IS” He signed the title and went and registered it. Now (a week later) he comes knocking on my door saying “We got problems.” He said he took it to a local dealership that checked it out and the mechanic says the rings are bad. He says he wants his money back or me to pay for the repairs. I told him I would check it out and get back to him. I researched it online and found that the lemon laws here in Georgia only apply to dealers and new cars. I, also found that private party sales are not mentioned in the law. I printed out the page from the GOVERNMENT website stating the law and took it to him. He says that there is another law regarding used cars. I have checked it out and found nothing. He informs me that he has an attorney on retainer and he will be contacting him tomorrow about this. I know I told him the car needs repairs and that my husband drove it with no problems. He drove it everyday! The guy test-drove the car and checked the oil and looked the car over really good and still took it home. Does he have the right to demand his money back or take me to court? Or does what I wrote on the bill of sale stand AS-IS?

I know it’s been over a year. I brought it in the day after I bought it as the check engine would blink every time my car would idle. They said put dry gas in it. It didn’t work. The car had a 30 day warranty. I brought the car back as the problem wouldn’t start and they said it was out of warranty. I got upset and they sent me to a different place 45 miles away (they owned) to get it fixed. I brought it there they replaced some coils etc and they gave me a loaner. They said it was fixed. I drove 45 miles to pick it up didn’t even get it home and the check engine light started to blink and came on.
So I called them up made another appointment. Brought it in. No loaner this time, had to wait. I was told it was the computer and they’d order one. (Note this service dept has 1, yes 1 mechanic). The company is pretty large and each business has it’s owner (one of the son’s of the original owner) and there is a CEO etc.
So anyways the mechanic never calls me back. I wait 2 weeks call him back and he said he wrote down the wrong part number to bring it back… so I brought it back (this is now about Oct) and he writes down the part number.
I missed a few appointments because of storms (lot of snow in winters of Maine). I call him back and tell him look this has to be fixed I have to get my car inspected. So he makes an appt with me.
I go in and he doesn’t have the computer he was supposed to order. He told me it was no longer under warranty and to get out.
I called his boss and tell him what’s going on. (I am now living in the same town where this mechanic works on cars). They decide to send me back to where I bought the car 45 miles away.
Well I did. And it’s been there since May 15. It’s been over 2 months. They replaced the engine (didn’t fix it). They cleaned carbon off the engine didn’t fix the problem. They never ran any diagnostics. They can’t figure out what is wrong nor can a ford dealership that they took it to.
First they wanted me to sell them the car for $1500 and eat the remaning amount I owed. Basically I owe 5500 and so they’d give me $1500 for the car, I’d still owe $4k. Then they wanted me to buy another car that they swore they would give me a good deal and take the price of the new car and add 4k to it. I told them no way. I wasn’t stupid.
So they’ve been messing around and not doing much with it. The few times they said it was fixed, it wasn’t. After 2 days they’d turn the car on, guess what check engine light came back on.
Now they say it’s the motor. They want to put in a rebuilt engine from a junk yard. I said no way. It had a ford engine in it when I bought it, I want a ford engine in it now.
All I wanted in the beginning was to switch cars. I told them it wasn’t inspectable and should never been inspected, they agree. I told them I am paying for a car I can’t drive, they agree.
Now because I won’t accept the used engine idea, they took away my loaner. I have no car to drive. They said it’s coz of lack of communication. Funny I just talked to them not more then 7 days ago. They said they tried calling me, I don’t have any missed calls from them (my voice mail box is filled up).
Now I am paying for a car, insuring it and I can’t drive it, I have nothing to drive.
I called the attorney general and because it’s been so long that they’ve been messing with this car, they are willing to do mediation. My other option is small claims court (max in maine is $4500 it wouldn’t even cover what I owe). I could do a lawyer, and I have one, but he said I’d pay him as much as I owe on the car. (It’s down to principal at this point).
So what do I do? Go to small claims court? I am definately speaking with the attorney general’s office and doing mediation. Meanwhile I have no car to drive. I can not drive that car off the lot (for one if the motor blows obviously they won’t cover it).
Isn’t there anything else I can do? I live in Maine.. it’s rural, how am I to get from place to place. I am driving a rental it is costing me a fortune.
Can the dealership do this? Can they hold my car hostage and not give me anything to drive? Can they mess around for over a year pretending to fix it when they didn’t even diagnose it?
Please any advice would be great. Yes I am going to the Attorney General (but it will take weeks, I can’t walk 25 miles to work every day). I can’t get another vehicle because I already have one loan out. I have NOTHING to drive yet I owe money on it.
I can’t talk to the bank, like an idiot I did in house financing (they have a so called “bank” that is owned by the same comapny… Lee Holdings)
It doesn’t fall under the lemon law as this law states the car must be less then 3 years old and under 18k miles.
All I want is for them to take this junk car back and give me a car that is worth the same amount that the other car was supposedly worth.

There are recalls open about the car catching fire and one of them was done but the others were not done prior to me buying it from the dealership. I had full cover insurance but I want Nissan to pay for it since its clearly a manuf. defect, I have been in contact with them but they are clearly testing my patience. I dont want to use my insurance because why should my rates go up and me spend out of pocket money for a faulty vehicle they built.
I have been trying to contact an attorney for this but most of they handle lemon law cases or if there was an injury but not just car fire
Anyone have any advise….???

The problem was there were many sick dogs, that she did this with. There was a contract signed by the owners, myself included. That contract waived the rights of the puppy lemon law for the state she lives in. I was not awar of a puppy lemon law. Well, before I knew about the others going through this, I contacted my court and we went through a couple of trials. They ruled in the favor of me to get paid back the cost of the dog plus all vet bills that occured. I later was contacted by the attorney general’s office stating that they are suing her for her conduct. There were many others going through the same thing I did. I never got paid, she lived in a different state, so it is difficult to send her a capias. She won’t do anything because she knows my sherriff is’nt going to another state to arrest her. Now I recently found out she moved again to a whole different state. How convienent is that? I contact the attorney generals office that has a case open with her, but every time I talk to them they say they are in the middle of talking with her attorney. It’s frustrating, because I lost my dog because of his illness, I put alot into this, and nothing in return. And what pisses me off, is she still does business on the internet making money charging more now than she had in the past. Should I continue with this fight? Or give up and say hell with it. This feels like a loosing battle. I get so mad knowing that she’s still getting away with this today. I Learned my lesson. If it sounds too easy, and too good to be true it’s going to rip you off.

What can I do? I am questioning my decision to adopt. Is there a program she can be put in?
She is currently in trouble and the courts are trying to impose parental sanctions on me! I’ve only had custody of her for a little over a year and the adoption was finalized the 8th of August. How is it that I’m responsible for the behavior she learned while in foster care? She was shifted from home to home, was sexually abused, and this is NOT her first brush with the law. Her mother is currently incarcerated and the majority of her natural family are convicted felons. No one would keep her except me. I thought I was doing a good thing.
I’m not a wealthy person. I cannot afford to pay restitution to her victim. I can’t even afford an attorney without trying to mortgage my home, which probably won’t work since I’m disabled and don’t work – I only get a small check each month to live on, even though my home is paid for.
My family tried to warn me but I was so optimistic. I figured since I don’t work I would have time for the child. Little did I know, when teenagers in the foster care system get away from their homes, they tend to go berzerk!
I can’t believe the mess I’m in. I feel so bad for the child but she has no conscience obviously. She thinks the world owes her. She fooled the heck out of me! I know it sounds cruel, but just like a used car needing a bunch of repairs, I got a “lemon.”
Where do I turn for help? The foster care people no longer are involved. They actually couldn’t wait to get her adopted – she had been in the system since 2002. And had been getting in trouble for the past 3 years, so I’m told.

Within the first week the truck stalled out on me. I called the dealer and they towed it in. It was there for a couple days and found nothing wrong with it. A day after I got it back, it wouldn’t start. Same thing, they picked it up and found nothing wrong again. During the next week or so it was fine, then the check engine light comes on, the truck starts shaking substantially at idle and finally stalls again. They take take it back a third time and find nothing wrong. And this goes on and on with a bigger list of problems. Finally I filed for Lemon Law with the NYS Attorney General, they set up an arbitration meeting with me and the dealer. They wanted to settle the complaint by putting me in a vehicle of equal condition, value and performance, I agreed. Went back to dealer to choose a vehicle and they said my only option was a Kia in fair condition that was worth half the price. I then wrote back to the attorney general saying they broke the deal but never got a response. I was forced to voluntarily repossess the truck cus it was just sitting in my driveway and I wasn’t going to pay for a truck I couldn’t drive. This was 3 years ago, my credit is now in the toilet, I can’t even get a credit card and am getting hassled by collection agencies. What can I do? Can I sue? I know Its been a long time but now I’m stuck, I need my credit and it only stinks because of this.
I POSTED THIS A WHILE BACK, NOW I WOULD LIKE TO KNOW WHAT KIND OF LAWYERS HANDLE THESE TYPE OF CASES. ARE THERE LEMON LAW LAWYERS, I CAN’T FIND ANY.

We ended up making a deal with the pet store that they would take him back and get him better, pay for him to get better then turn him back over to us when he was 100% healthy. A vet (that has a contract with the pet store) said he was 100% so we took him home. Its been a week and a half and we noticed that his nose was runny again so we took him in today. He is still sick!!!! We contacted the pet store and told them this and said the dog wasnt 100% that we think we should get a refund, they said no, talk to your attorney, we have already paid enough for him. I dont want to give them my dog but this doesnt seem fair! Does anybody know anything, laws, anything that could help us??

Have you ever been in this situation? Do you have any suggestions? Do I need to call an attorney or the Better Business Bureau?

I was recently thinking how I would really ENJOY being an attorney, but specifically an attorney that deals with “lemon law”. You know, like purchasing a new car and everything going wrong with it, so you need a lemon law attorney.
What steps do I need to take to becoming an attorney that deals with lemon law? I’m 24, do you think it’s too late to study law? How long will it take me?

I am interested in becoming a lawyer, but I have a lot of school loans/debt and I cannot pay for law school. However, I am eager to learn and take the exams. I would like to work for myself and practice general law or become a lemon law attorney and help individuals who may have purchased a new car from a dealership and turns out to be a lemon.

So I called on Aug. 25 and told them that if I don’t get a call back from the attorney to find out what in the hell is going on, then I’m going to find another attroney. He then called me back and told me that he got an offer from GM…..what a coincidence, they day I threaten them going to a different attorney, he calls back and gives me this shitty offer, that even he told me not to accept. Back to The waiting game again. Since Aug 25, he hasn’t gotten back to me. Is there something wrong with my lawyer or is this lemon law process normal. What should I do?

You will get as close to the exact same car as can be arranged. If the new car has a higher price, you will not have to pay the difference, unless you want any changes in the vehicle. Like now you want a sun roof and your old car didn’t have one. You would have to pay for that extra equipment. Probably up front to keep your loan payments the same.

He kept up with the maintenance with the car(being only a few months in his possession all he needed to do was an oil change). Driving to school the other day the power steering belt and alternator belt went out. He got it towed to a shop in which they told him about the alternator and belts. Apond further inspection they found the engine is screwed. Apparently the engine has major damage to it, it was previously leaking oil and the original owner or possibly the dealership used some oil stop leak to patch it up and sell it. It is a 2005 Toyota Camry with 80,000miles so I’m pretty sure it is out of the manufacturers warranty.
Does he have a case to get his car fixed or is he screwed? Is he protected under any lemon laws or since it is a used car the seller is protected “as is”? By the way this is in Texas.

You buy a new car. The new car has a problem during the period of the factory warranty that can’t be solved (any problem would be considered, provided it detracts from the ownership experience or impacts the value/utility of the car). The “can’t be solved” test varies state to state, but 3 unsuccessful repair attempts is usually enough to get the ball rolling on a lemon law claim. Most of the time, the manufacturer of the new vehicle will invite you to arbitration before the lemon law can take effect.
In order to document that your vehicle’s problem can’t be solved, you’ll need your local dealers help. They’ll need to provide you with a repair order that shows they were unable to fix your problem – but the repair order MUST document the problem exists. Furthermore, you must give the same repair facility every reasonable opportunity to fix your car.
My advice would be to speak with your dealer’s service manager – he or she will be able to either help you with your claim or ask your vehicle’s manufacturer for arbitration.
If you purchased a used car with a problem, you’re probably out of luck. While some states have laws regarding buying a used lemon, they’re poorly written and hard to enforce. That is a legal process anyways – you’ll need to hire an attorney to guide you if you bought a used car with faulty ABS.

None of the dogs near us have parvo. She says it was in the air on our ride home. Parvo is not airbourne as far as I know. Any good advice is appreciated. I don’t want this don’t buy from breeders crap or that there are millions of dogs dying in shelters I know this. We wanted this specfic breed of dog.

I bought it from Video Only in Federal Way, Washington. those guys must be ex-car salesmen,,,out the door and they don’t even want to talk to you anymore…Anybody have any ideas on this? There must be three repair attempts for the same defect or condition, OR at least 15 cumulative calendar days out of service for one or more defects or conditions, before submitting the Motor Vehicle Defect Notification (MVDN). If you do not have the required number of repair attempts or days out of service, then continue to take the vehicle to the dealer for repairs.
Please Note: If your complaint is based on the vehicle being out of service for 15 or more days the manufacturer or its authorized agent has the opportunity to inspect or repair the vehicle. If the vehicle still does not conform to the warranty for a total of 30 or more days and the manufacturer has had the opportunity to repair, you are entitled to request arbitration.

I am not buying any kind of extended warranty form them. I’m getting the car as is. I did have my own mechanic look it over and he says it is a good car. But am I protected under the lemon law?

I recently purchased a 95 honda accord for $2,200. It came with 4 after market rims, 1 rim was off the car and had a donut in its place. The seller told me that it just has a small leak in the tire and just needed fix a flat. Well i later discovered thet there is a hair line crack in the rim about 3″ long that leaks air out of it. That rim is useless and to make matters worse its discontinued. Its a Katana concept 7 and i cant find any other rims that look like it. I read that there is virtually nothing i can do to fix it and that it is extremely dangerous to drive on it. I also have a 6 month old daughter. The recipt does not say as is. Do i have any options if he wont help me. Could i take him to court or use the lemon law?

(We’ve already contacted Chrysler and notified them of the defect, and have given them their final attempt to repair.) Do we need an attorney? Has anyone had to put up with this headache of a situation? Please share if you have.

When we purchased it, they assured us that everything had been checked out on the car and the only thing it needed was one fuse that they were willing to fix themselves. (We were inclined to believe them because we have bought a vehicle from this dealership before and my father got to know one of the managers semi-well.) So, we put the down payment on the car and they had it ready for us the next day.
When I picked it up and drove it off the lot, the light for the back hatch was on and it was dinging.So, I drove it right back and they said it wasn’t latching right. They couldn’t fix it and gave me a card of where to take it to the next day and said there would be no charge.
THEN, the next day, they called me to tell me I needed to bring it back because they forgot to do some inspection whatever on it and they would give me a loaner car. I stopped to get gas on the way to drop it off and the little door to where you pump the gas wouldn’t open (there’s a little button inside the vehicle that you have to push to open it). When I got to the car lot, he told me they would fix both the hatch and the fuse to the little door.
They called me yesterday to let me know it was ready. I picked it up and they had not fixed the hatch or the door to pump the gas. I was really frustrated, but was going to have my dad call the guy and talk to him. I figured that maybe I was just still supposed to take it to the other person to have it fixed and they would still pay for it.
To end this long, irritating story, we went out to eat last night with my family and when we went to leave, the car wouldn’t start. It seemed like it was the battery, so we got a jump. We had to make one stop on the way home and shut off the car. It started back up just fine and I thought all was well. About 4 minutes later, it died on the road. After that, it wouldn’t even hold a jump; it kept dying and had to be towed home.
I know we did buy the vehicle without a warranty, but we had the thing less than a week and there is clearly something wrong with it. They either did not fix the first fuse they were supposed to fix, it’s the battery, or worse, the alternator. If there is a major problem, am I screwed because there is no warranty? Or would a Lemon Law protect me because it hasn’t been 30 days?

On the trip to Illinois, the airbag light came on. I took it into Dealership 12/08. They “reset” the error, basically something happened and air bag system went into a “Fail Safe” mode and deactivated. 2 weeks later it happened again, this time I took it in, and they replaced the entire passenger bottom seat cusion and weight sensor within. 1 week later it happened again. I took it back, this time they replaced the main control unit for the Air bag Deployment system. It was just coming on at random times. The dealership told me to not put ANYTHING or ANYONE in the seat and see if it comes back. I did this, about 9 days later I was driving 12mph and a kid in a residential street came out of his driveway into the road, I hit the brakes and the light came on. I called the dealership and they said “maybe the inertia of the stop caused this, it may be normal” WHAT???? Normal for your airbags to deactivate when you hit your brakes?? hahahaha… SO with that logic, I am to just not hit the brakes to try and avoid and accident, because if I do hit the brakes, my airbags will render deactivated just as I plow into someone?? I contacted Nissan USA, and they called me this morning and said “We have reviewed the case, and at this time we cannot buy your vehicle back” I then asked them to provide me a list of all engineers, sales people, technicians, and managers that can atest that should I get in a side impact or head on collision that my airbags will work as designed. SHe said she would call me back… I got a call back from another representative that said they ARE going to buy it back. They want authorization to speak with my bank regarding payoff, copy of registration and original sales contract. I am not sure if they are aware yet that technically it is still a “Used” vehicle. If they DO come back and say “Sorry, this is used, we cannot support it under the Lemon Law” and say, to bad…you bought a used vehicle…what can I do? It is just at 30k miles now. I only have 6k miles till I hit the warranty expiration. Can I go back to dealership?
Help!!
